One major reason I think UMass pampers the hard core student party culture living off-campus is the simple fact Peter Clark and Emerson Rutkowski are still students in good standing. 

The first major incident of violence towards our police department occurred at the very beginning of the semester last year.  September 9, 2011 to be exact.  Peter Clark was the party DJ.  He was proud enough to use it for a cover photo on FAH-Q Facebook page for his DJ business, even after the extensive negative press.

Currently he uses a photo from one of the three recent Townhouse (where he lives) riots.

Because of the notoriety I first bestowed upon Peter Clark, the Amherst Bulletin and Daily Hampshire Gazette gave him a front page platform to air his cocky, immature party hardy philosophy to the masses.

And that was quickly followed up by the King of Juvenile, Bar Stool Sports, making him out to be a modern day James Dean (although "without a cause" certainly fits).

When he and stooge sidekick Emerson Rutkowski were driving neighbors crazy in a residential neighborhood in South Amherst and the household garnered repeated noise/nuisance tickets as a result, they formed a Facebook page called "F_ck The Fines!"

This kid is worse than a serial repeat offender, because he's actually proud of it.  And as a "professional" DJ, he profits by it.  Fast forward to early Friday morning: Peter Clark and  Emerson Rutkowski were arrested yet again for Noise and Nuisance violations at their Meadow Street Townhouse apartment.

And it sounds like the cop could also have thrown in a charge of resisting arrest or assault on an officer.

At the very least, this makes three arrest incidents in just the past 18 months.  So if Umass really wants to show they are cracking down on the rowdy behavior terrorising our neighborhoods, then they they need to do what our military does in the "War On Terror":  take out the ringleaders.

And for the lowly likes of Peter Clark or Emerson Rutkowski, you don't need an expensive drone strike. Just expel them.  Peter Clark famously stated, "As long as I’m here, there will always be a party to go to."

Well, the flip side to that ...

The first weekend of renewed joint patrols between University Massachusetts PD and Amherst PD has yielded (rotten) fruit as officers on foot patrolling Lincoln Avenue/McClure Street had to dodge a bottle thrown from the bushes by John Moffitt of Andover, MA, age 19, who was arrested for underage drinking and disorderly conduct. 

"Disorderly conduct" is an apt description for that entire area, a kind of town/UMass DMZ border, although -- as usual -- problem houses made their presence known in other areas far from the UMass campus.  Take for instance 120 Amity Street, almost in the center of town.

APD was called at 1:39 AM early Saturday morning to clear a crowd of 150-200 "uncooperative" guests from the "one family" residence and arrested two uncooperative party hosts: Nikoli Sotil, 209 E Granby Rd, Granby, MA, age 21 and Nick Freiter, 257 School St, Taunton, MA, age 21

Police were called to #25 Hobart Lane yet again for a party of 100-150 inside the apartment and another 200 milling around the road in front around 12:30 AM early Saturday morning.  Two residents were issued noise tickets and another cited for underage drinking.

A half hour later on North Pleasant Street, within spitting distance of Hobart Lane, Andy Thach, 7 Olympia Drive, Amherst, MA, age 22 was arrested for disorderly conduct and was noted to be "extremely ETOH" (drunk).

Around that time (1:02 AM) a patrol car was flagged down on Sunset Ave by a female advising the officer another very drunk young man was trying to fight with people and he appeared to have urinated on himself.   After running down Sunset Avenue onto UMass property, he was arrested by UMPD

In the furthermost reaches of North Amherst (1:10 AM) police were breaking up a party at 198 Sunderland Road because of loud noise and with 30-40 guests near the road a car barrelled by almost hitting some in the crowd.

Police chased the gray sedan and pulled it over on Rt 116 (yes, the same highway where a UMass student only weeks away from graduation was killed last year by a drunk driver going the wrong way) and arrested the driver Kevin Chan, 352 Silver Lane, Sunderland, MA for drunk driving.

Also in North Amherst  (2:21 AM) at the intersection of Meadow Street and North Pleasant the commercial center of N. Amherst police arrested Christopher Wade for drunk driving.


And of course what would a weekend of revelry be without Phillips Street?

Early Sunday morning (1:16 AM) police responded yet again to 45 Phillips for a loud stereo and guests up on the roof who were "very uncooperative."  One of the guests tried to prevent the arrest of his brother and he was also arrested for disorderly conduct and resisting arrest.

Late Friday around midnight police observed two youthful looking individuals exiting #19 Phillips Street carrying a 12 pack of beer, an address where police had visited previously to speak to tenants about civility.  Both were issued summons for underage possession of alcohol.

Around midnight Saturday police were called to 84 Sunset Avenue, a one family home actually occupied by a family, for a Breaking & Entering.  Arrested for underage drinking, open container, and destruction of property over $250 in value:

So to repeat what I wrote yesterday about the coordinated PR surge Amherst and UMass are now jointly putting forth on the their solutions to problem party houses in town, I question if either has the will to actually back up their tough talk.  And now, for your consideration, I present exhibit B:

Board of Health Problem Houses

Interesting that this "list" of dwellings the Board of Health has dealt with since the June 30 start of FY13 does not give exact addresses?

When a public health problem rises to the level of being placed on a watch list, that list becomes a public document.   And since the Board of Health is an investigatory body with state mandated powers I assume they put the exact address on their list.

So why protect them from public exposure?  Don't neighbors have a right to know about a problem house in their neighborhood (although they are usually all too familiar).  Isn't that why the state has a Sex Offender rule for public exposure of their whereabouts?

Notice the Board of Health has issued only one fine (to a house somewhere on Glendale Road) out of the 60 or so locations on the list, or under 2%.  No indication if it was for the $50 minimum or $1,000 maximum, or anywhere in between.

And it's also interesting that this fine was issued only last week.  Since this powerpoint slide is to be presented tomorrow night to the Amherst Select Board as part of the Town Manager's report on "Safe and Healthy Neighborhoods", a conspiracy theorist might think they just randomly picked one token house to fine in order to demonstrate toughness. 

At least the 9/13 basement apartment fire at Gilreath Manor on Hobart Lane shows up (but only as "Hobart Lane").  At least we now have an official admission from the town that those basement apartments were indeed illegal.  And they have given the owners an "Order To Correct"... at least.

That seems to be an apt description for the efforts the town and UMass are showing for enforcement action:  At least.

And a sternly worded letter too!

Yet Another Smoking Gun

I thought that I would apprise you of a situation in which your assistance would be welcomed. Last Thursday the Fire Department responded to a basement fire at # 28 Hobart Lane. 28 Hobart Lane is one of the 14 units that Lincoln Realty owns and manages in the 3 apartment buildings collectively called Gillreath Manor Apartments. The basement contained 2 illegal bedrooms. One of these would be considered to be OK as a bedroom with some modifications as directed by the Building Commissioner. The second bedroom 1) physically cannot be used as bedroom and 2) exceeds the maximum occupancy of 4.

Currently, the Fire Department, Health Department, and Building Commissioners office are awaiting the opportunity to inspect all 14 units in the complex. On Monday the 17^th of September, we were invited to inspect 2 of the 14 units. We observed two rooms, constructed without permits, in each basement with no beds contained therein. We did observe two beds that had been stacked beneath the stairs in each occupancy.

The issue: We have one email and now one phone call from the displaced occupants that clearly indicate that they have been instructed by Lincoln reality to remove the evidence of the two illegal bedrooms until after the combined inspections. We are working with the University to acquire permanent residence hall accommodations for the 14 students who will be displaced from the 5^th bedroom in each unit. It appears that the 28 students displaced from the basement bedrooms are in need of temporary accommodations and I believe that Lincoln Realty needs to step up and procure these temporary living arrangements.

The charade needs to end and these kids need safe housing.. To date, we believe that we (the combined inspection departments) have not proceeded in an untoward manner, we have withheld action through an administrative search warrant instead seeking to act cooperatively with Lincoln Realty to inspect the apartments and we are very cautiously approaching a cease and desist order to compel Lincoln Realty to reduce the occupancy of the apartments to 4.

Any assistance you may be able to provide in motivating Lincoln Realty to provide the necessary temporary housing would be greatly appreciated.

Two violations jump out in this AFD report, one not so serious, one deadly serious.  Amherst has a zoning bylaw limiting unrelated tenants to four per household -- that's the not so serious violation.

State building codes requires two means of egress from a basement bedroom -- that's the deadly serious infraction.

As I pointed out in my original post, what if the fire had happened in the wee hours of the morning rather than 12:00 noon?  A fire across the main floor would have trapped anybody asleep in those basements.

Two bedrooms per unit times six units:  "Nobody gets out of here alive."

Student rowdyism escalated yet another notch late last night as Amherst Police officers had to physically defend themselves against combative college aged youth jet-fueled by alcohol, a danger to innocent bystanders, first responders and themselves.

Last week two drunk students unabashedly fighting in a downtown restaurant got physical with a female Amherst police officer who was attempting to break it up, and early this morning the violent response to APD officers continued unabated.

Around 12:30 AM an officer noticed a disturbance at 45 Phillips Street with about 20-30 males on the front porch yelling and throwing punches at each other.  In trying to break up the melee one of the perps "attempted to free his friend" from the cops hold and had to be pinned against a fence and placed under arrest.:


Officers later cited the house, owned by Stephan Gharabegian, with a $300 ticket for violation of the town's Nuisance House Bylaw.

 Around 2:00 AM police were called to Hobart Lane apartment #26 Gilreath Manor for reports of a fight involving ten individuals.  In breaking up the disturbance an officer was hit with pepper spray and required a response from AFD to rinse his eyes.

Arrested for Assault & Battery on a police officer, A&B with a dangerous weapon (pepper spray), Resisting Arrest, and Disorderly Conduct:

Around 2:45 AM police responded to 15/17 Fearing Street for reports of a "highly ETOH" (drunk) individual "throwing bottles at people."

The responding officer was greeted by a dozen young men on the front porch who stated Jonathan Jacobs was "going crazy," throwing bottles and other items at them.  Due to his violent behavior they had evacuated the house.  Jacobs was located in his upstairs room but immediately became combative, assaulting one officer with his shoulder and knocking over another.  At APD headquarters he refused to identify himself and was held on $2,500 bail.

Meanwhile around 1:15 AM police responded to a report of a motor vehicle crash on Mattoon Street near Amherst Regional High School.  The driver reported swerving to avoid a pedestrian and lost control because of the "wet roads", but an eyewitness had another different version not involving a pedestrian.  The driver was given a field sobriety test and failed.

Sadly, at 1:43 AM, UMass police, APD and AFD responded to a male who fell and hit his head near the Newman Center, UMass.  The first officer on the scene reported the male was on the ground surrounded by friends who confirmed he "had been drinking" and suddenly collapsed, hitting his head.  

AFD transported the unconscious young man to Baystate Medical Center in Springfield, where he is reported to be on a breathing machine in the Critical Care Unit.

UPDATE (Monday afternoon): The young man was released from the hospital Sunday at 2:30 PM.  Let's hope he learned a lesson.

Fire in the Hole

On Thursday September 13, just after high noon, Amherst Fire Department responded to a basement fire in apartment unit #28  on Hobart Lane, notorious party street and home of the infamous "Hobart Hoedown".

Fortunately the call came in at the perfect time --if there is such a thing for a structure fire -- as first responders were not overwhelmed with ETOH calls (alcohol poisoning), thus AFD quickly put down the blaze.

Since the "three bedroom" unit shares a large building with five other units, had AFD not caught the fire in time, the results could have been catastrophic -- especially if the blaze had started 12 hours later in the late evening of "Thirsty Thursday" when the building would have been packed with distracted students.

According to Lisa Queenin, UMass Director of Community Relations,  "The Dean of Students office and Residential Life are working with the students to make sure the five students have housing and the support services they need in the wake of the fire."

Note the number:  Five students.  Yes, a violation of Amherst zoning bylaw forbidding more than four unrelated housemates.

On Friday the morning after the fire, according to Amherst Police Department logs:

"Firefighter Mike Roy (Fire Prevention Officer) received information that Lincoln Realty had warned the residents that an inspection was imminent and that they needed to assist in hiding code violations. I assisted with contacting the DA's office and the Clerk of Courts seeking an administrative warrant to enter the apartment for inspection."

On the day  or even evening of the blaze, the fire department could have entered the building for an inspection under MGL 148 Section 4, but because 24 hours had passed they needed the administrative warrant, as the owner (Kathryn Grandonico) was not being overly cooperative.

According to Building Commissioner Rob Morra that inspection was delayed until Monday afternoon. And because of 4th Amendment concerns the "administrative warrant" only applied to the damaged apartment and adjoining units on either side (three total) rather than the entire 14 unit complex.

Evidence suggests an extra bedroom in the basement of those three units inspected on Monday.

The entire 14 unit complex is assessed at $1.5 million or $30,000 in property tax overhead, although it's quite possible those extra 14 tenants (if indeed all the units have an extra tenant) would about cover that.

A good deal for the landlord ... unless of course one of them overburdens an electrical circuit.

Gilreath Manor, built in 1982, does have vertical firewalls between units. Fire however tends to move in an upward direction and would quickly get into the attic above the firewalls to engulf other units.

Party Houses of the Weekend

Yeah, already I can use the pleural of Party House.  Not a good sign.

According to the above-the-fold front page story in today's venerable Gazette, UMass is taking a "lighter approach" to controlling student party behavior, using cartoon characters to enlighten them to the pitfalls of over consumption of alcohol.

Umm yeah, almost as good as handing out oatmeal cookies.

My favorite nugget of wisdom they are passing down to freshman from more senior students who presumably learned from their bad experiences is this one:  "Just because you suddenly have access to alcohol doesn't mean you have to consume it all at once."

Take for instance a young woman at 41 Hobart Lane, who was taken into Protective Custody for being ETOH (beyond drunk).

According to APD logs:

"RP reports loud music, partying and drunken shouting 1:33 AM (early Saturday)"

"Young woman observed attempting to urinate in front of residence.  Unable to state which town she was in.  Was observed to have bloodshot, glassy eyes, slurred speech."

The tenant of record at 41 Hobart was cited for violation of the town's noise bylaw ($300 fine).

Another dumpster fire at Hobart Lane late last night, an almost weekly event over this past year.  And it happened right around the same time AFD was responding to an attempted suicide in another part of town.  Just one of the many reasons dumpster fires are not taken lightly by authorities, as they tie up valuable resources with more important things to do.

Last January police arrested a Umass student for the idiotic activity, but the fires persist.

The Gazette jumped all over the Puffers Pond Patriots Day trashing fiasco although, strangely, did not quote from the original email I first posted below which was sent to the Select Board, Town Manager, Conservation Director and anybody who is anybody in town government.  Story will no doubt be above-the-fold Front Page article in tomorrow's Amherst Bulletin, which does not hide behind a paywall.

In addition to the major disturbance at Townhouse Apartments on Meadow Street profiled in the post below, alcohol related incidents kept Amherst police on the go all over town--but particularly so in immediate neighborhoods around UMass: Fearing Street, Hobart Lane, Phillips Street, and North Pleasant Street.

In all Amherst Police issued seventeen $300 noise tickets ($5,100), twenty five $300 open container/underage drinking tickets ($7,500), and eight $100 possession of under one ounce marijuana tickets ($800) for a grand total of $13,400 in civil fines.

And most troubling of all, arrested two individuals--one male, one female--for the criminal offense of Driving Under the Influence.

By now you have probably read in the Main Stream Media about the tragic death of a 24 year old motorcyclist from Amherst hit by a driver going the wrong way on RT116 near UMass very early Saturday morning.

I have no confirmation (yet) that it was alcohol/drug related, but I've driven that route a thousand times and can't understand how you end up going the wrong way on such a well signed state highway in good weather conditions.

Amherst Fire Department was also scrambling to deal with high call volume--so much so that we had to rely on mutual aid six times for an ambulance.  Note high number of ETOH (passed out drunk) calls that tied up our highly trained EMERGENCY first responders:

Oddest event of the weekend?  An 18-year-old arrested for "disorderly conduct" after urinating in the living room of a Meadow Street apartment.  He was, amazingly, drunk. Well in that case, not so odd.

I am a resident who lives near Puffers Pond and I was just made aware of the mess that was left by students this evening.  Luckily a few individuals cleaned-up after the students, but this is above and beyond having fun.  One of the 'clean-up crew' had shared these images with me and honestly, they made me sick.  I am not sure who or what department they should be forwarded to, for something to happen - so that this does not occur again!

Editors Note:  UMass is now the largest employer in Western Massachusetts and has been Amherst's largest employer for over 100 years.  Every September Amherst is blessed to have thousands of exuberant new consumers flock to the University for the first time.  99% of UMass students are industrious, mature, decent individuals driving on the road to success.  It's the 1% you read about here.  And they need to change their act.

This one bedroom colonial at 1156 North Pleasant street, only a stone's throw from North Amherst center or Hobart Lane and Meadow Street--ground zero for student party houses--sold in early March for $264,000, well below its accessed value of $373,500.

The new owners, Catherine and Morten Jensen-Hole, will go before the Planning Board on April 18 for a rubber stamp "site plan review" to e-x-p-a-n-d from one family (maximum of four unrelated occupants) to a two family, or eight unrelated tenants.

Even though the rental income potential doubles, the assessor does not increase the valuation of the property whatsoever, so the tax revenues to the town remains the same.  Last week the Zoning Board of Appeals approved (as did the Planning Board) just such a conversion for a yellow house at 156 Sunset Avenue, but not before neighbors made their concerns loudly known about the quality of life issues associated with non-owner occupied student rentals.

Like the melody of a song that gets stuck in your head, "200 Commonwealth Ave", the Mullins Center address, will stay with me for a while as that became a loop run for Amherst Fire Department ambulances starting even before the Rusko concert (drunken young woman fell and broke her arm).

UMass Police did their best to be proactive: patrolling expansive parking lots with an armored car and unmarked patrol cars--swooping in when alcohol was visibly in possession by minors--but on nights like this, you may as well bail out the ocean with a plastic red cup.

The concert started at 7:30 PM, but over an hour later coatless young men in short sleeve shirts and young women dressed in even shorter black skirts with midriffs exposed, streamed down Commonwealth Avenue from the Southwest area heading toward the Mullins Center, while many of the vehicles converging on the scene had out-of-state license plates.

The good thing of course is the concert kept thousands of students on campus, the bad thing, however, is our Fire Department became like a Domino's Pizza delivery service--carrying cargo from the Mullins Center to the Cooley Dickinson Hospital.

And the saddest thing? It's become routine.

Not to confuse anyone with the headline, because the on-campus revelry did not seem to add much of a burden to the Amherst Fire Department above and beyond their "normal" hectic routine for weekends in a "college town."

The dumpster at Hobart Lane, scene of 30 previous fires before a perp was recently bagged red handed (currently no longer enrolled at UMass) was again the scene of wasteful, destructive fires late Friday and Sunday evenings. As Chief Nelson points out, when AFD responds to such a nuisance fire that ties up resources so they can't respond instantly to a "real" emergency.

And notice once again a cluster of ETOH (passed out drunk) calls late Friday early Saturday once again tied up ALL our on-duty resources, leaving the entire town (and regional towns who rely on our EMS) under the protection of the volunteer Student Force.

And in spite of their impressive capabilities, not a super situation.

Heads up police work by a patrol officer in an unmarked car early Sunday morning (12:45 AM) may have brought an end to the serial dumpster arson cases that have plagued North Amherst for over a year now. When the officer spotted three young men near the dumpster and detained them for questioning, one individual--Travis Consolo--was acting particularly nervous.

And for good reason: While the officer was questioning him, the dumpster--which had ArsonWatch reward poster affixed to it-- exploded into a conflagration. AFD put out the fire; Consolo, a UMass student, was arrested.

Since August of 2010 this particular dumpster has been torched 30 times. Police and Firefighters distributed informational flyers to the immediate neighborhood around Hobart Lane back in October, reinforcing the reward offer posted on the abused dumpster.

God help Amherst residents should a medical emergency or fire have happened last Saturday night around 10:00 PM; sure, Northampton FD would have arrived...eventually.

Rowdy student behavior doesn't just keep residents awake on weekends--it also squanders the precious resources of the Amherst Fire Department. And it's not like UMass has a fire department of its own.

The Mullins Center, owned by UMass, so a tax exempt entity, hosted a giant party on Saturday night in the form of Deadmau5 a DJ "artist" who mixes music and probably plays it loud enough to garner a $300 noise ticket if he were playing on Meadow Street or Hobart Lane.

The AFD wisely based an ambulance and paramedic crew on scene and, sure enough, they handled eight cases (alcohol related) thus avoiding a costly trip in time to the Cooley Dickinson Hospital, where the average turn around for handling a single drunk student (once they get there) is an hour, more like an hour-and-a-half if blood, vomit or other body fluids spill inside the ambulance.

Meanwhile between 9:16 PM and 11:50 PM four more cases of ETOH (too much alcohol) required transport to the hospital, thus depleting the cavalry should Fort Amherst require assistance. You know, the normal working person who pays property taxes to help finance our $4 million Fire/EMS system.

Yes, the student call force (for fire calls only) and one professional firefighter to supervise were available, but if your most precious asset was in imminent danger--is that the response you expect?

Update/correction: UMass does pay a fee (like hiring police for a traffic detail) for the extra ambulance assigned to the Mullins Center for special occasions.

Saturday night as the witching hour fast approached, a half dozen squad cars and the large transport van (referred to as a "paddy wagon" way back in the day) converged on the center of Meadow Street directly in front of the main entry to Townhouse Apartments, where students had been congregating all night long--fueled by warm humid air and beer.

Like Old West cowboys, APD herded the massive crowd of students away from Meadow Street--which by then had become impassable to cars--back into the confines of the sprawling apartment complexes that consists almost entirely of UMass students.

Then they turned their attention to the large house on the slummy side of Meadow Street with all the cars parked on the lawn, which had been attracting overloaded taxis for most of the night--contributing to the gridlock on Meadow Street.

As the officers moved as a unit towards a side entrance where a few residents were still milling about I heard the clang of an empty beer can ricochet off the road at their feet.

This congested, claustrophobic--dangerous--scene of too many students and too few cops was replayed on Phillips Street, Hobart Lane, and upper North Pleasant Street between 10:00 PM and 1:00 AM. With students crossing those roads freely back-and-forth in droves, I'm amazed there were no people vs car incidents.

Meanwhile, back in Amherst center McMurphy's and Stackers had lines of young people waiting to get to the bar, while next door a friendly crowd formed in front of Antonio's Pizza, happily chowing down. Cell phones chirped, a street musician played the xylophone and an incessant car alarm was almost drown out by the cacophony of loud conversations coming from consumers all along the busy street, looking for something to do.

Just another late Saturday night in our little (college) town.

While most responsible adults spent Saturday evening preparing for the wrath of Hurricane Irene (which fortunatley never arrived) these bad boys were having an end of the world--or perhaps start of the semester--party. Or maybe, since it was the main leaseholder's 20th birthday, a birthday bash.

The Amherst Police Department is serious about keeping our community safe and comfortable for all citizens--and that includes "quiet enjoyment" of one's most important asset, their homes.

According to police narrative:

"Approximately 50 guests standing outside of number 41. Estimate another 30-40 inside drinking and shouting. Resident identified and issued TBL (town bylaw) for noise. Guests cleared out."

With all available APD boots on the ground including both Captains and the Chief, reinforced by five state police and one k9 unit the town is under control.

Anyone trying to enter Hobart Lane for the mythic "Hobart Hoedown 2011" has to cross a police checkpoint and if their names are not on the tenant street list someone who lives in the apartments must come down to vouch for them (In the hour I was there many quickly turned away.)

The bars in downtown Amherst are not turning any students away, however.

Amherst Police Department's crack down on rowdy students behavior continued this past weekend with an escalation of tactics: rather than issue $300 tickets for alcohol violation perps were arrested, cuffed and thrown in jail.

And with a shift to "sector" saturation greater police presence (both APD and UMass police) occurred all around the Gateway corridor--especially Phillips Street, Nuting Avenue and North Pleasant Street as well as the usual suspects, Hobart Lane and Sunset/Lincoln Avenues.

In all Amherst Police arrested over 25 college-age students rather than issuing a $300 ticket--mostly for "open container" and "underage drinking" violations. One more arrested for Driving Under the Influence and only one $300 ticket issued for "open container" and two for "noise" violations.

With a $10,000 state grant providing for additional police overtime, expect greater police presence on weekends between now and graduation.
