Another cry of wolf

Last year as part of their PR campaign to dump Amherst Town Meeting article #24, which would allow the town manger free rein to negotiate a deal with BlueWave Capital for electricity generated by the proposed joint public/private solar farm, NIMBYs brought up the issue of an environmental catastrophe from run off oozing from ye old landfill.

Town officials used multiple credible sources to counter their alarmist allegations and Town Meeting went on to overwhelmingly approve article #24.  Not long after, those same NIMBYs filed a lawsuit against the town using everyone's favorite "just-say-no" attorney (unless it's for a library in his hometown of Shutesbury) Michael Pill.

The state legislature, however, will soon enact a bill to make his expensive lawsuit moot by releasing any municipality who accepted Department of Environmental Protection money for capping a landfill from the provision stating it could only then be used for passive recreation. 

Late this afternoon the town manager--via our official town website--issued a "Statement REGARDING SAFETY OF AMHERST'S MUNICIPAL DRINKING WATER" in response to "photographs of a wetland in the vicinity of Hop Brook circulated via email."

The 13 photos were anonymously uploaded by someone using the handle "ForcleanAmherst" on a free photo sharing website they only joined on Feburary 20.  The post is far from popular as most of the pictures have around 50 views.  Although those numbers are sure to go up after the town manager fired off his "newsflash" to all Amherst subscribers.

The nonexistent wolf has been slayed, again.

Neighborhood Shake Up?

So it will be interesting to see (and hear) how the immediate neighbors living near our economic Leviathan react to the news that Lincoln Apartments, which for over fifty years housed families, graduate students, UMass staff, and visiting faculty will now be accepting the dreaded "undergrads."


Well, maybe.  


According to a polite memo to the neighborhood from Lisa Queenin, Director of Community and Regional Legislative Relations: "With the housing pressures on campus and our desire to maximize all available housing options for both undergraduate and graduate students, we may open Lincoln Apartments as a housing option to senior undergraduates who choose to live in this quiet community"


Lincoln Apartments is contiguous with Fearing Street, which is located in the heart of the Gateway corridor leading to UMass from Amherst town center.  Frathouse Pi Kappa Alpha, the scene of violent fights this past weekend (earning them two $300 "Nuisance House" tickets from APD) is located on the corner of Fearing Street and North Pleasant Street and the worst party street in town, Phillips Street, is one street over.

Rowdy student party houses poisoning the neighborhood was reason #1 the Gateway Corridor Project-- a joint commercial/residential  mixed-use development between the town and UMass-- was derailed.

The two acre parcel of property (formerly "Frat Row") that was to be the crown jewel of the town/gown joint development is now also a potential site for additional housing, assuming the Gateway project does not arise from the dead.

Bad Form Rising



Select Board member Jim Wald posted to the unofficial Amherst Town Meeting listserve (privately owned by Mother Mary Streeter, protector of all things Larkspur Drive) an ominous sign for proponents of article #17, Form Based Zoning--the most controversial warrant article coming before Fall Town Meeting.

The information packet snail mailed to all Town Meeting members will be slightly delayed because when town staff crammed the quaint 9" by 12" brown manila envelopes with all the information printed on the remains of dead trees, the mailer was overweight by USPS bulk mail standards (and generous are those standards). Yikes!

Of course the main reason was the plethora of paper pertaining to Form Based Zoning. And as pretty as it is with all the color graphs and architectural renderings, as with Godzilla movies, size does matter.

Form Based Zoning is already in trouble because as the name succinctly says it's all about zoning, with zoning requiring a two-thirds super majority of Amherst Town Meeting. And naysayers (NIMBYs) are usually more motivated than calm, rational altruistic members who simply have the best interests of the town at heart.

Town officials should take a hint from the simple two-word description of the zoning amendment and synthesize all the supporting materials down to one single page of text, about the same number Lincoln used in the Gettysburg Address.

Town Meeting is about as simple an institution as you can get, so by all means, apply the KISS principle!

Gateway is Gone

The Gateway Corridor Project, born September 1, 2010, died Wednesday August 4, just shy of age one, after contracting an all too typical case of NIMBYism.

The ambitious Gateway was conceived out of an optimistic, rare partnership between Amherst and UMass, as an urban renewal project with a mixed-used commercial development of high end student housing, commercial retail, and office space, a signature building or two plus significant green space, to revitalize the corridor connecting downtown Amherst with our flagship University.

The Amherst Redevelopment Authority adopted the infant and acted as nursemaid.

But the generational pessimism ingrained in the nearby neighborhood by seasonal waves of rowdy students, combined with overly inclusive public officials who allowed self interested "stakeholders" to hijack the public process, inflicted a heavy toll.

Gateway supporters were so concerned about negotiating the Town Meeting gauntlet--where a two thirds vote is required for zoning changes--that they watered down the project immensely, thus alienating a major player.

On August 4th UMass rescinded the offer to transfer ownership of Frat Row, the Gateway's crown jewel, a two-acre swath of open land dubbed a critical "catalyst" by ARA consultant Gianni Longo. The prime piece of property that ignited the very idea of a "Gateway."

With its heart and soul gutted the grand idea is gone. Now, Gateway belongs to the ages.

When all else fails, lawyer up

If a judge can throw out an arrest where perps are busted red handed with guns, drugs and a bootleg cable/Internet connection because the search warrant had the wrong house color or some such nonsense, then I suppose the NIMBY lawsuit filed against the town (and threatened against BlueWave Capital) to prevent a solar farm from sprouting on the old dump by citing a technicality, stands a chance...like snow in the Sahara.

The state is now on a crusade to encourage public/private renewable energy projects, and solar farms on old landfills is a shining example. The disputed deed restriction (or lack thereof) was/is between the town and the Department of Environmental Protection.

According to Boston based attorney John Wadsworth, who specializes in Environmental, Energy and Natural Resources law: "If there is any violation it is a violation of DEP solid waste regulations for not recording the restriction, not something that prevents DEP from revising the restriction for this use."

If DEP had any concerns, then why did they grant the permit last year for the Final Comprehensive Site Assessment?

Since the eight households have a combined assessed value of around $4 million, safe to say they can afford the litigation co-op entry fee (when Mary Streeter tried to rally NIMBYs on Larkspur Drive to legally battle the decision to allow Dr. Kate Atkinson to build a medical office in the Research Park out that way the entry fee would have been $2,000 each).

But the $8,000 to $10,000 cost to squash this nuisance lawsuit will be spread out over 10,000 housing units who will benefit many times over by the $1 million per year net gain in economic benefit to the town. A bright future indeed.

So what do you really think?

The red hot issue of a sparkling new solar farm on a dreary old abandoned landfill certainly arouses passion and, as such, folks--especially NIMBYs--tend to shoot from the hip...usually folks who are lousy shots to begin with.

And never is it more evident then those hilarious occasions when they accidentally fire off an email to an entire listserve thinking it was a private response to only one individual.

Gavin Andresen had strongly defended the town's wish to enter a contract with Blue Wave Capital to construct a solar farm generating electricity and a cool million per year in payments and savings on land now sitting empty, costing the town tens of thousands per year in maintenance overhead.

Mr. Andresen even had the gall to publish a GIS photo showing one of the prominent NIMBYs who posts sky-is-falling rhetoric has a backyard touching the landfill.

I met him once for a few minutes and he struck me as 'one of those' BY the way the solar thing will be somewhat close to where I live but I am not an abutter or even close. It's just that I no longer trust Musante-Okeffee,et. al. As far as I can tell they're working for Maroulis. The unanimity of the boards is a tad frightening.

Actually Mr. Byrne is fairly close to the old landfill, but considering he paid $359,000 for his unit five years ago and it's currently valued at only $215,300, he probably does not have to worry about a Solar Farm reducing the value any further.

Of course Mother Mary was informed and took down the offending post and even warned not to "reply all" to the original message as that would resend the string with the offending remarks, but I notice Mr. Bryne still did so last night in an attack on the Gateway Project and as a result resent the original ad hominem attack on Mr. Andresen.

Since Gavin also has a blog I'm sure he has thick enough skin to withstand such biting commentary from the peanut gallery. And (Princess) Stephanie O'Keeffe used to have one.

Solar Shoot Out

Monday's Amherst Town Meeting is shaping up to be an ultra-modern shootout at the OK corral where combatants carry Star Trek phasers instead of six shooters.

NIMBYs fire off a half-page ad selectively quoting from a NIMBY website that selectively cherry picks facts from oceans of Department of Environmental Protection required data, but still doesn't endorse the expensive sky-is-falling ad; and the town quickly (and cheaply) responds with a full spread of photon torpedoes via the main page of the official town website, normally a place where people go to figure out how to pay parking tickets.

While the old unlined landfill these folks bought expensive homes around certainly does produce lots of leachate--especially when it rains--that fluid is not exactly a toxic green goo oozing towards the town water supply. If you try to reuse a teabag for your fifth cup of tea, the results will be mighty disappointing.

All the groundwater monitor wells (28) around the old landfill fail to show contamination beyond a few chemicals and even then only in traces and it flows in the opposite direction from the municipal water supply over a mile away. Plus the methane/sulfur gas detectors (9) stationed around the perimeter all test completely negative.

In fact, the most recent DEP report to the town (2010) clearly states in bold letters: "Groundwater does not flow towards the Lawrence Swamp public water supply wells, which are located over one mile to the south/southeast." And if that is not clear enough, they boldly sum it up: "The qualitative risk assessment concluded that there were no significant risks to human health or public safety posed by the landfill."

The main reason the town is under orders from the DEP to regrade the cap is because the contents have settled, causing the cap to sag from a lack of support from down below allowing rain water to pool in places. Thus the regrading will help with water runoff and will most certainly aid in reducing leachate production.

But that is not what conflicted neighbors will unleash on Town Meeting Monday night. Instead, a doomsday scenario that could pass for a science fiction disaster movie trailer. YouTube here they come.

Gateway intensive visioning

Last night's three-hour kick off charrette--1st of three--started out with a bang as it looked for a moment like the public meeting would become part two of the Jerry Springer show when Town Manager John Musante was interrupted in his opening remarks by Murray Eisenberg (an immediate neighbor) demanding to know the status of "undergrad housing" within the Gateway.

Musante took advantage of the jarring segue to announce the "Memorandum of Understanding" signed by Chancellor Holub, former Town Manager Larry Shaffer and ARA Chair John Coull on September 1, 2010 was now "off the table," meaning specifically private student housing would no longer target undergraduates--the major concern of vocal neighbors (assuming developers can stay within state and federal housing law).

And since deputy chancellor Todd Diacon was in attendance and did not throw his magic marker at Musante, it probably has UMass approval. At previous ARA meetings Diacon clearly stated that undergrad housing is not the main interest of his employer.

Between 70-90 folks crowded into the Bangs Community Center where they sat at random around ten tables, each with a large color zoning map of the north end of Amherst. First assignment was to define the Gateway area. Obviously the UMass owned former Frat Row was ground zero and one table envisioned the area as only that (called "minimalist" by ACP consultant Gianni Longo) and it would stay open green space, while the majority of tables drew broader lines both north and south, east and west or combinations of the two.

The "Preliminary Assessment for Urban Renewal Eligibility" shows (as neighbors pointed out early on) that no "blighted" properties exist in the region, as blighted only applies to vacant structures.

And in the immediate area directly opposite Frat Row a good number of properties are identified as "exhibiting decadent conditions" meaning poorly maintained structures with either peeling paint, broken windows, dangling electrical wires, etc.

In order for the state to approve an "Urban Renewal Plan" and allow the ARA full use of all its tools--including eminent domain--the area must be deemed in need of rehabilitation on a grand scale. But since the "area" has not yet been defined, that process will take place at a later date.

Solar farm moves forward

Despite vocal opposition from immediate neighbors, the Select Board tonight voted unanimously to recommend article #24 to Amherst Town Meeting, a motion that will allow the Town Manager (who is appointed by the Select Board) to enter into a long-term contract with BlueWave Capital for low cost electricity generated by a sea of solar panels placed on the old landfill.

ARTICLE 24. Authorize term of lease for Old Landfill (Planning Board)
To see if the Town will vote to authorize the Town Manager to lease all or any portion of the Old Landfill across Belchertown Road from the existing Transfer Station from time to time by one or more leases for such term of years up to 30 years and for such consideration as the Town Manager shall determine, for the purpose of installing and operating thereon a solar array for electric power generation and distribution, and to authorize the Town Manager to grant such easements in, on, under and across over said land for utility and access purposes, as reasonably necessary to install and operate such a solar array, and further to authorize the Town Manager to enter into a power purchase agreement with any lessee of such property to purchase all or a portion of the electricity production of the solar array and to enter into an agreement with the local utility to participate in the Net Metering program pursuant to the Acts of 2008, c. 169, §78, the so-called Green Communities Act, as may be amended.

No wonder the folks cocooned in high-end houses on Tanglewood Drive are so heated about the town finally getting around to turning the expensive old dump into something productive--a lucrative, environmentally friendly solar farm.

Not only do they now enjoy a great view, but some of the folks have enhanced that view by encroaching on town property.

Solar powered Electric Chair?

This detonation of a backpack nuke at last night's Select Board meeting--publicly suggesting Amherst will be an "accomplice in a capital crime"--was obviated a couple hours later, when reading from a prepared statement during his Town Manger's report, John Musante informs the Select Board he's given up on using DEP approved contaminated soil to regrade the old unlined landfill.

Still, you gotta love Mr. Boothroyd's borrowing from Steve Jobs the "one last thing" intro before dropping the bombshell.



End result? The town losses $250,000 in disposal fees paid in work/equipment barter from the major contractor rebuilding Atkins Corner, who will now have to pay cash to another disposal facility at a greater rate per ton for the 6,000 ton load.

And the town will have to rely on street sweepings and catch basin crud to try to make up the difference for the regrading but will probably have to bring in clean fill at additional cost in labor and cash. All in all, a lose-lose scenario.

Twenty years ago Mr. Keenan enhanced his "fiscal conservative" image by volunteering to clean up pigeon poop from the Town Hall attic after Town Manager Barry Del Castilho (worried about the health of his secretary, who later became his wife) was preparing to spend over $100,000 to have a hazardous waste disposal company clean it up.

And a couple weeks ago Mr. Keenan blew the whistle to DEP about 20-30 barrels of potentially hazardous waste (paint from UMass) that was buried somewhere in the landfill over 25 years ago by town DPW workers.

But if everyone is also so concerned about the integrity of the landfill cap, then why try to force the town into cracking it open to dig for those 20 or 30 needles in a haystack?

John Boothroyd and Dave Keenan, two outspoken critics of the town's attempt to recast the old unlined landfill into a sea of shiny solar panels took their battle directly to the Select Board at the unscripted 6:30 PM "Question Period" tonight, focusing on the potential health hazard of pesticide laced soil approved by the DEP as partial fill to repair sagging areas of the landfill cap due to settling common after 20 years of decomposition.

John Musante, during his "Town Manager's Report", told the Select Board the contaminated soil controversy had created "a lot of anxiety" and become a "distraction."

The regrading of the landfill will occur regardless of the solar array project and since the use of lead arsenate soil was a relatively minor part of the overall work, he directed DPW chief Guilford Mooring to abandon the idea of using 6,000 tons of tainted soil from the Atkins Corner Road project, although he praised Mr Mooring for "trying to be entrepreneurial".

Musante by no means backed down on the ambitious project to construct a 4.75 megawatt solar farm on the landfill that could provide the town with a million dollars per year in combined electricity savings and property tax revenues.

Searing the solar farm



Yes this is the same Diana Spurgin who fours years ago was treasurer of the 'Amherst Plan Committee' a band of soccer moms, well paid academics and 'Amherst Center' types pushing a $2.5 million "Three Year Plan" tax Override hatched by our Finance Committee, at the time toothless watchdogs who acted more like lapdogs for town officials.

And of course their main propaganda pitch, as usual, was to shame taxpayers into voting yes for the collective common good especially for the sake of the children, who attend one of the most expensive public school systems in the state.

Ahh, but when it comes to a creating a higher-and-better use for town property, a deal that could benefit the common good by $1 million per year while reducing our carbon footprint, don't disturb the tranquility near my backyard (an unlined landfill).

Amherst Solar Farm meets Jerry Springer show!

The only thing missing among the crowd who jammed the town's solar farm public forum Wednesday night was bullhorns, pitchforks and torches. Perhaps a better headline would be: "When NIMBYs attack."

Yes amazingly enough these restless natives who purchases expensive homes next to an old unlined landfill are worried a commercial solar array will ruin their property values. After all, real estate agents promised them the landfill would remain open space for 99 years. And if you can't trust real estate agents who can you trust? Used car salesmen perhaps?

The complaints aired ran the typical gambit: noise, visual pollution, losing open space to walk the dog and go sledding, turning the neighborhood into another "Love Canal" and--my favorite--Russia dealing with Chernobyl compared to the way Amherst town government is now going about the process. Yikes!

Kind of far fetched to claim the solar array will cause damage to the landfill cap when DEP will have to approved it after exhaustive study and the expert the town is partnering with, John DeVillars is a former New England Administrator of the U.S. Environmental Protection Agency

A couple years ago Town Meeting was going to award Guilford Mooring "Mr. Congeniality" for his patient, good natured, humorous way of presenting DPW issues to that legislative body. So for him going Postal, says a lot...

ZBA approves ABC permit...finally!


Third time was the charm as the ZBA last night, after two annoying continuations, approved by unanimous vote (which was required) the "special permit" necessary to allow the Amherst Brewing Company the right to pay a Connecticut company a lot of money (but essentially the same as what they were paying a local landlord for their smaller downtown location) to transform the former Leading Edge Gym on University Drive into a cozy, comfortable, responsible, adult-oriented--as opposed to rowdy student--brew pub.

Nice way to celebrate St. Patty's Day, eh?

Party house of the weekend

Strangely enough there were none this weekend--or considering it was Spring Break week--perhaps not so strange. I bet Florida had more than its share. Although the previous weekend there were more than enough party hardy contenders for the award, so I'm sure at tomorrow's Amherst Redevelopment Authority meeting the subject will come up during Public Comment period as ammunition to torpedo the Gateway Project.

Apparently I left too early last night (babysitter issues): the ZBA unanimously acknowledged that there are no issues to cause a denial, but never actually came to a formal vote on the special permit...yet. Next Wednesday they will finish up crafting the "conditions" for approval and, hopefully, take the formal vote.

Now you know why it takes so long to get anything done in Amherst!

Tonight the omnipotent Zoning Board of Appeals unanimously headed towards approving an ever-so-slight change in usage called a "special permit", crucial for the Amherst Brewing Company to relocate a mile from Amherst town center into a larger, more open commercial space on busy University Drive (so named because it is a main artery to UMass) with a plethora of free parking.

I say omnipotent because the ZBA (appointed by the duly elected five-member Select Board) is essentially the same as a state Governor deciding a death row pardon that requires a unanimous approval from all three sitting members.

This would now make two consecutive business friendly decisions from the ZBA, turning aside organized neighborhood protest lamenting noise, traffic and--in the case of ABC--the all too familiar complaint about potential rowdy student behavior fueled by too much alcohol.

In fact on Monday night, Select Board Chair Stephanie O'Keeffe (during a discussion defense for hiring a new Building Inspector to enforce housing health and safety codes) succinctly stated, "There is nothing more important facing the town right now than the quality of life issues in the neighborhoods. The issue of student rentals, student parties...they really affect every single permit application that comes before the ZBA, Planning Board."

She goes on to issue a stern challenge: "This is an area we need to be serious about. Not just for the quality of life for people today, but because of it being an obstacle to making progress for the future."

Even the formerly over optimistic folks over at "save our Gym" and revive the Leading Edge seem to agree with my assessment that the ZBA all but approved the permit and will simply dot the i and cross the t on Wednesday:

There is discussion of alternate spaces. It would be a much bigger and more complex project.

Select Board Supports Gateway

Last night the venerable Amherst Select Board unanimously passed (with one abstention) an advisory resolution supporting the "public process" about to commence with the Gateway Corridor Project, a unique coalition of three significant public entities: UMass, the town and the Amherst Redevelopment Authority.

(Aaron Hayden abstained on the supportive vote as he is also a member of the ARA.)

While this may appear at first glance a common sense, non-controversial edict, the subtle purpose was to offset a petition delivered to the Select Board last December decrying the broad nature of the public input process and demanding a series of public meetings focusing on the misperception that Gateway is simply a means to "adding a substantial number of undergraduates to old Frat Row."

The ARA meets this evening to choose a consultant (estimated cost $30,000 in state money) to lead the "visioning process" over the next four months. Let the wider public input begin.

ABC MIA from Town Center?


Once again the Zoning Board of Appeals seems poised to cast another, gasp, pro-business decision; this time in favor of the Amherst Brewing Company, an established bar/restaurant, to relocate its successful operation a mile from town center into a larger commercial space located on a busy direct route to Umass, the Golden Goose of stable employment for all of Western Massachusetts.Formerly The Leading Edge, aka Gold's Gym

Thus it appears the NIMBYs power to snuff development in Amherst is, finally, beginning to wane--on a couple of major fronts. The ZBA, after a protracted hearing process, allowed the variance required for Dr. Kate Atkinson to practice family medicine in a Professional Research Park, thus she will construct a $2.5 million dollar LEED certified 16,000 square foot building, enhancing the taxbase not to mention providing quality medical care to her thousands of patients.

And last week the public hearing to allow ABC to move into the former Leading Edge Gym location in a larger commercial building a mile down the road seemed to garner major public support--including Stephanie O'Keeffe, the Chair of the Amherst Select Board, and Tony Maroulis , the Executive Director of the Chamber of Commerce and a plethora of patrons far removed from the college aged stereotypes neighbors seem to fear the most.

Those speaking in favor of the variance pointed out the previous tenant, a Health Club operation open 100 hours per week, was far noisier than the brew pub and the Jones Library currently adjacent to ABC has never had complaints about either the noise (and a library would notice) or any odor complaints due to the brewing process or routine cooking.

Meanwhile the Amherst Redevelopment Authority is steaming forward with the Gateway Corridor Project, an urban renewal joint effort between Umass, Amherst and a private tax paying developer to significantly beautify the main corridor connecting the campus to the downtown. We have whittled down the original field of four consultants for the "visioning process" to only two and both will come in to pitch their expertise in person at the next two meetings (in Executive Session.)

The ARA will award the consultant contract by March 1st. The ZBA meets again March 10 to present their decision concerning the ABC. I'll drink to that.

Former Amherst Bulletin Columnist Baer Tierkel countered in an email to the Planning Department saying "I received an anonymous letter asking me to write against this move, so be aware that there is a campaign against this move being hatched-anonymously My guess is it is from people who want their Gym (Leading Edge) back , of which I was a member, but do not have a viable plan to make that happen. So they are sabotaging another local business with their anonymous campaign."

Let the floodgates open

Four viable consultants responded to the Gateway Project RFP

February may be the shortest month of the year, but for the Amherst Redevelopment Authority it will be our busiest in over a generation with three meetings scheduled to peruse proposals submitted by consultants competing for the job of leading a "visioning process" to ensure public acceptance of the proposed Gateway Project, the most ambitious undertaking for the ARA since founding almost 40 years ago.

At our last meeting 1/31 we were presented with the four consultant proposals and a legal opinion from the town attorney stating that Umass is indeed exempt from all local zoning when it comes to the Gateway Project, meaning they can do whatever they damn well please with that property--especially since they paid $2 million to acquire it, and tens of thousands more to demolish the five frat houses.

Of course if vocal NIMBYs had their way, the ARA would be spending the next three meetings playing solitaire. Their unelected leader, John Fox, appeared before the Amherst Select Board on 12/20/10 to submit a petition that requested a moratorium on the current consultant search.

Ironically the consultant is being hired precisely to attract and engage ALL stakeholders (including taxpayers townwide) in a process that allows EVERYONE a voice to shape what develops at that strategic location--not just those immediate neighbors with a misguided sensitivity fueled by a bawdy recent past.

This outreach curation will include at least six provincial stakeholder meetings and then another three Charrettes--a kind of Three Ring Circus where everybody gets to come under one big tent to share feedback.

By March 1st we will have chosen a consultant; they will spend 8 to 10 weeks dealing with a myriad of planning details--not to mention voluminous feedback from the general public.

Then the consultant provides the ARA with an initial draft of the "Gateway Project Vision" and we put it under our microscope. They then come back with a revised version incorporating our suggestions and that version, hopefully, is finalized by a majority vote (preferably a unanimous vote).

And even then, the finished proposal is formally presented in a joint public meeting of the ARA and the Planning Board. All leading up to the biggest hoop of all: a two-thirds vote of Amherst Town Meeting to approve the new zoning required for turning this dream into reality.

Yes, more hoops than a Chinese hula hoop factory. But in the end, well worth it.
