Mini Hobart Hoedown

Hobart Lane is kind of like Phillips Street in that it will probably never live down its (well deserved) party reputation, even though there has not been a "Hobart Hoedown" in many years.

For you nubies the Hoedown preceded the Blarney Blowout, but of the same basic idea:  day drinking until you get completely out of control, and when police arrive throw dangerous objects at them.

Amherst police encountered two rowdy party goers very early Sunday morning trying to force their way into #29 Hobart Lane.  When they refused to comply with instructions to leave -- and physically resisted police -- officers had no choice but to arrest Kyle Bisceglia and Matthew Langford, both age 20.

Matthew Langford (6 feet 2 inches tall, weighing 200 pounds) was charged with Disorderly Conduct, Resisting Arrest and Assault and Battery on a police officer.

Kyle Bisceglia was charged with Resisting Arrest and Disorderly Conduct.

Both are hiring their own attorney and they will return to Eastern Hampshire District Court in mid-December.

ZBA Accepts Surrender

It took two hours and ZBA Chair Eric Beal seemed to want to let the public thrashing of a prominent local landlord go on for two more hours, but he finally relented and voted along with his two fellow board members to allow Grandonico Properties, LLC -- AKA Lincoln Realty -- to withdraw their appeal of the Building Commissioner's $100/day fine for violation of the town bylaw restricting one family units to four unrelated housemates.

Originally the Grandonicos appealed the Building Commissioner's decision, claiming they should not be fined because they were unaware of their tenants (overcrowding) actions and should therefor not be held accountable.

The tenants -- all UMass students -- contacted UMass legal services and their attorney, Carol Booth, put together overwhelming testimony showing the Grandonicos were well aware, and in fact encouraged, violation of the town zoning bylaw.

After a potentially catastrophic fire that started in an illegal basement bedroom of #20 Gilreath Manor on September 13, the tenants were told by their landlord to hide evidence of bedrooms in the basements, which borders on obstruction of justice -- a criminal charge.  

After these documents became public due to the ZBA hearing (and this blog), the Grandonicos wished to turn off the spotlight by simply withdrawing their appeal.  Tonight they got their wish.

But the ZBA still strongly reaffirmed the right of the Building Commissioner to levy fines on the landlords for infractions that occur on their property.  A message that will not be lost on other landlords in town.

Strategic Withdrawal?

Against the tragic backdrop of a deadly fire at Rolling Green Apartments, I'm not surprised Grandonico Properties, LLC -- AKA Lincoln Reality -- is attempting to quit their foolish appeal of Amherst Building Commissioner Rob Morra's December 17, 2012 citation carrying a $100/day fine for violation of the towns 20+ year old zoning bylaw forbidding more than four unrelated housemates in a one-family unit.

But I hope the ZBA does not  allow them (requires a unanimous vote) to simply surrender and slink away under cover of darkness. I hope they take up discussion of this important issue and vote unanimously to reaffirm it.

By taking up this health and safety issue that Grandonico sought to circumvent, and now wish to pull a Roseanne Roseannadanna "never mind",  the ZBA can send a stern message to a minority of unscrupulous landlords who put profits over public safety.

Fire in the Hole



Another dumpster fire at Hobart Lane late last night, an almost weekly event over this past year.  And it happened right around the same time AFD was responding to an attempted suicide in another part of town.  Just one of the many reasons dumpster fires are not taken lightly by authorities, as they tie up valuable resources with more important things to do.

Last January police arrested a Umass student for the idiotic activity, but the fires persist.

APD Bags Arsonist Red Handed

Heads up police work by a patrol officer in an unmarked car early Sunday morning (12:45 AM) may have brought an end to the serial dumpster arson cases that have plagued North Amherst for over a year now. When the officer spotted three young men near the dumpster and detained them for questioning, one individual--Travis Consolo--was acting particularly nervous.

And for good reason: While the officer was questioning him, the dumpster--which had ArsonWatch reward poster affixed to it-- exploded into a conflagration. AFD put out the fire; Consolo, a UMass student, was arrested.

Since August of 2010 this particular dumpster has been torched 30 times. Police and Firefighters distributed informational flyers to the immediate neighborhood around Hobart Lane back in October, reinforcing the reward offer posted on the abused dumpster.

Party House of the weekend

So I had a hard time deciding a winner. On the one hand, we have 21 Hobart Lane which garnered two (2) $300 "Nuisance House" town bylaw violation tickets, but my favorite is 47 Hobart Lane (owned by Jones Properties) which only garnered one.

According to police logs narrative by the responding officer: "Resident (Brian P, age 21) called stating their were to many people surrounding his house that he did not know. Approximately 100 people observed around 47 Hobart Lane. Brian P approached me in the roadway asking to help clear people from his house. I advised him to enter his house, turn the music off and tell people to leave. Officers began to clear people out with minimal cooperation. Several underage drinkers observed who were summoned. Approximately an additional 150 people were cleared from the house. Empty beer cans/bottles and trash covered the ground surrounding the house. Brian P issued Nuisance House bylaw citation."

The reason why I like this one is because the perp called it in on himself. Priceless.

And this, of course, is #27 the house in between #47 and #21-all odd number appropriately enough. This one is also owned by Jones Properties. Gotta wonder if Watroba's misses their banner?
