Christian Rivera stands before Judge O'Grady

No matter how much you like "Stand By Me," if a police officer tells you to turn it down, you should probably turn it down.

Mr. Rivera, age 21, did not -- and as a result was arrested by APD for violation of Amherst noise  bylaw.

In Eastern Hampshire District Court on Monday he took the standard "diversion" program, having the criminal matter diverted to a civil matter in exchange for paying the $300 noise ticket and promising to stay out of trouble in the near future.

Although, since he's a UMass student, Rivera will also have to answer to the UMass Dean of Students Office as all arrests and/or Noise & Nuisance tickets issued by APD automatically get referred to Enku Gelaye for review.

Had the violation occurred on campus UMPD probably would have issued Mr. Rivera one of the new tickets they are using to speed up the process of dealing with Student Code of Conduct violations.

Only in the past few years did UMass e-x-t-e-n-d the Code of Conduct to include off campus activities such as noise and nuisance complaints handled by the understaffed Amherst Police Department.

Hey Larry, do you know if Richard Marsh of Belchertown who was tragically killed recently is the same Richard March who has signed numerous posts on your blog?

A terrible tragedy. My prayers go out to his wife and family.

Good to see UMASS is taking care of matter both on and off campus. Sad that they have to but then again college is the sophomoric years of life for most people.

Yes, I bumped into District Attorney Dave Sullivan as he was heading into District Court this morning and he confirmed that UMass cracking down on these off campus incidents has made a BIG difference.

I've always felt if you can't use your name then little you say warrants any discussion. Sadly many today are so spooked by the phoney identity theft industry that they will not put their name to much, even a post on-line.

At least this guy dressed respectfully for his court date, unlike a lot of the perps we see in Larry's photos. That should count for something. Richard Marsh.

The joy of anonymity is that regardless of how often we hear that you are free to say what you like without repercussion, there's always repercussion. I'd rather be called a CAN than worry about how my boss will react. I prefer to keep my job. If you think what we CANs say merits little regard, I guess we just have to live with that. Take the "anon" option off the table if it bothers you so much.

Anon 12:16pm. You really have a job, and/or an employer that would retaliate against you for an opinion? If so, that is a very heavy burden, basically you have to hide your true self.
Not necessarily casting doubt on you particularly, but I believe most anons simply don't want their employer, spouse, friends, etc to know their true opinions. That is cowardice. Richard Marsh

It's not cowardice, RM. It's nothing more than someone exercising their right to separate their home and work lives. Pretty much a no-brainer. If you can't see why a person would want to do so, you're kind of stupid, no offense.

Glad you're not dead so we can continuing arguing about petty things.
