So it's good to know Amherst police can use their basic powers of observation (and smell) to bring charges of driving under the influence of marijuana, because I have a feeling we're going to see more and more of it in the not too distant future.

And the case of Jackson B. Gale, age 19, goes to show UMass police do have the power of arrest anywhere in town. At the time of the incident (3 AM) every available Amherst police officer was at the scene of the homicide in South Amherst.

ReplyDeleteIs that exactly a prudent thing to do, Larry? Not only could there have been someone coming the other way, but the perp could have lost control and gone into the side of someone's house. It's happened before, and at that speed, you quite likely would have spilled gasoline igniting.
I can understand the desire to catch him, but 97 MPH in a residential neighborhood for nothing more than spinning tires and suspected OUI?
As a crippled for life stoned DWI driver victim facing yet more knee replacement surgery after a decade of taxpayer paid nursing homes and a second decade of disability -we know what the DWI druggie trolls say -" Just get over it -get a life " I"m all for that -what such a criminal did precluded it-must be nice -druggies don't pay a price !!!

This is why we need to permanently take cars away from DWI drunks-especially high speed on the lam-I lost my right to drive-because I WAS HIT BY A DWI HIT & RUN CRIMINAL PERP_he got off with ONLY 3000 hours community service-1 year loss of license- WHY VICTIMIZE THE VICTIMS..killer on the road-sweet memory will DIE !!
ReplyDeleteYou do understand that force equals mass times acceleration and hence a "DWI hit & run criminal perp" driving 47 MPH, while dangerous, is far less dangerous than one driving 97 MPH!

UMass police do not have arrest powers everywhere in town. Stop spreading fallacies. Their jurisdiction follows them (or any cop) provided they have an arrestable offense prior to leaving it. Not only is OUI arrestable, its jailable which grants even greater leeway under the continued pursuit theory. If an arrestable M offense occurs in their jurisdiction and UMass pd chases, they can make that arrest anywhere in MA.
ReplyDeleteThe only other times UMass can make an arrest lawfully in town are for a warrant, a felony or under a call for service (mutual aid).
We have a mutual aid agreement with UMPD signed about a year ago. You know, after the Blarney Blowout.
